Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of the Thynkr platform operated by Thynkr Pty Ltd (“Thynkr”, “we”, “us”) at thynkr.com.au. By creating an account or using the platform, you agree to these Terms.

If you are under 18, your parent or carer must consent to your use of Thynkr. Where a school facilitates access, the school is responsible for obtaining this consent in accordance with the Queensland Department of Education’s Online Services Consent procedure.

2. What Thynkr Is

Thynkr is an AI-adaptive study platform designed for Australian secondary students preparing for the QCE. It provides:

• Adaptive practice sessions aligned to QCAA syllabus statements
• AI-powered tutoring and explanations
• Misconception detection and correction
• Spaced repetition scheduling
• ATAR estimation, tracking and optimisation tools
• Career and university pathway exploration
• Parent progress visibility (with consent)
• Teacher class analytics (via school agreements)

Thynkr is a supplementary study tool. It does not replace classroom teaching, professional tutoring, or school-based assessment.

3. Accounts

3.1 Eligibility

• Students must be enrolled in an Australian secondary school (typically Years 7-12)
• Parent/carer accounts must be linked to a student account
• Teacher accounts require a valid school association
• You must provide accurate information when creating your account

3.2 Account Security

• You are responsible for keeping your login credentials secure
• You must not share your account with others
• You must notify us immediately if you suspect unauthorised access: support@thynkr.com.au

3.3 Account Types

• Student: Individual learner account
• Parent: Linked to one or more student accounts for progress visibility
• Teacher: School-associated account with class analytics access
• Admin: School administration (teacher management, school settings)

4. Subscription Plans

School licensing is subject to a separate agreement. Contact schools@thynkr.com.au.

4.3 Billing

• Subscriptions are billed monthly or annually as selected at purchase
• Annual plans are billed as a single upfront payment
• Prices are in Australian Dollars (AUD) and include GST
• Payment is processed via Stripe. We do not store credit card details

4.4 Cancellation

• You can cancel your subscription at any time via account settings
• Cancellation takes effect at the end of the current billing period
• You retain access until the end of your paid period
• No partial refunds for unused time within a billing period

4.5 Refunds

If you experience a technical issue that prevents you from using the platform, contact support@thynkr.com.au within 14 days for a pro-rata refund.

We comply with Australian Consumer Law regarding consumer guarantees.

4.6 Free Tier

• The Free tier is available indefinitely with usage limits
• We reserve the right to modify Free tier limits with 30 days’ notice
• Free tier users receive the same content quality — gating is on throughput and features, never on content

5. Acceptable Use

You agree not to:

• Use the platform for any purpose other than personal study or teaching
• Share AI tutor responses in ways that misrepresent them as your own original work for school assessment submission
• Attempt to access another user’s account or data
• Use automated tools (bots, scrapers) to access the platform
• Upload content that is unlawful, harmful, threatening, abusive, or offensive
• Attempt to reverse-engineer, decompile, or extract source code from the platform
• Circumvent usage limits on the Free tier through multiple accounts or other means
• Use the platform to generate content for commercial purposes

We reserve the right to suspend or terminate accounts that violate these terms.

6. Content and Intellectual Property

6.1 Our Content

• All platform content (questions, explanations, knowledge graphs, UI) is owned by Thynkr Pty Ltd
• QCAA syllabus references are used under fair dealing for the purpose of study and education
• You may not reproduce, distribute, or commercially use platform content without written permission

6.2 Your Content

• Conversation history, notes, and uploaded materials remain yours
• You grant Thynkr a limited licence to process your content for the purpose of delivering the service (e.g., sending your question to the AI tutor)
• We do not use your content to train AI models
• You can export or delete your data at any time

6.3 AI-Generated Content

• AI tutor responses are generated by AI and may contain errors
• AI responses should be verified against authoritative sources (syllabus documents, textbooks, teacher guidance)
• ATAR predictions and university course mapping are estimates only — they are not guarantees of outcomes
• Thynkr is not responsible for academic decisions made based on AI-generated recommendations

7. ATAR Tools Disclaimer

The ATAR Estimator, Smart ATAR Tracker, ATAR Optimiser, and University Course Mapper provide estimates only based on the data available to the system. They are not:

• Official ATAR calculations (only QTAC calculates official ATARs)
• Guarantees of university admission
• Endorsed by QCAA, QTAC, or any university

Scaling parameters and historical data used in these tools are approximations. Actual ATAR results depend on statewide cohort performance and are calculated by QTAC after all results are finalised.

8. Limitation of Liability

To the maximum extent permitted by law:

• Thynkr is provided “as is” without warranties of any kind
• We do not guarantee that the platform will be error-free, uninterrupted, or secure at all times
• We are not liable for any academic outcome, ATAR result, university admission decision, or career outcome arising from use of the platform
• Our total liability for any claim arising from use of the platform is limited to the amount you paid for your subscription in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded under Australian Consumer Law.

9. Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Thynkr, you agree to the Privacy Policy.

Key commitments:

• All data stored in Australia
• Student data is never used to train AI models
• No advertising, no tracking, no third-party data sharing for marketing
• Data deleted within 30 days of deletion request

10. School Use

When Thynkr is used via a school arrangement:

• The school is responsible for obtaining parental consent per the Queensland DoE Online Services Consent procedure
• Teachers access class-level analytics only — they do not have access to individual student billing or parent account information
• Schools may request data deletion for all students onboarded via their school at any time
• School licensing terms are governed by a separate School Partnership Agreement

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes:

• We will notify active users via email at least 14 days before the changes take effect
• Continued use of the platform after changes take effect constitutes acceptance
• If you disagree with the changes, you may cancel your account before the effective date

12. Termination

We may suspend or terminate your account if:

• You breach these Terms
• You use the platform for purposes other than study or teaching
• Your payment fails and is not resolved within 14 days
• Required by law or government order

On termination:

• You lose access to the platform immediately
• Your data is retained for 30 days in case of accidental termination, then permanently deleted
• You can request data export before termination

13. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
